John W. Smith Jr., an Independent candidate in the three-way race for delegate of Virginia’s 100th District, was found not guilty Monday of a misdemeanor charge of stalking.
The 60-year-old Hallwood man was tried in Accomack General District Court after his neighbor, Bonnie Merritt, claimed Smith “has been stalking and taking pictures of me and my family for over a year.”
Smith said he was acquitted because it is not illegal to take pictures in Virginia. He said it didn’t constitute stalking and added, “It might be annoying and all that. If they didn’t do things wrong, I wouldn’t have to take their picture.”
Smith contended that he is harassed by the Merritts because they dispute the shared boundary lines.
